COMMUNICATION COMMUNITY TERMS OF USE

1. WELCOME TO THE COMMUNITY! 🎉

Welcome to Communication Community LLC (the "Community"), hosted on the Circle platform! We are thrilled to have you here. This Terms of Use Agreement ("Agreement") ensures our Community remains a safe, respectful, and enriching place for all. Please read it carefully.

2. YOUR AGREEMENT WITH US

By accessing or using our Community, whether as a member of the Open (free) Community or the Premium (paid subscription) Community, you agree to abide by this Agreement and any future amendments. If you do not agree with these terms, we kindly ask you not to join or continue your membership.

3. AGE AND ELIGIBILITY

To join the Community, you must be at least 18 years old and have the legal competence to enter into this Agreement. By joining, you confirm that you meet these requirements.

4. ACCOUNT CREATION AND SECURITY

To access certain features of our Community, you'll need to create an account. Your account information should be kept secure—think of it as your digital key to our Community. You are responsible for maintaining the accuracy of your information and ensuring the confidentiality of your login credentials. Sharing your login information with others is prohibited.

5. COMMUNITY MEMBERSHIP TIERS

  • Open Community (Free): This membership grants you access to a variety of general resources and discussions within the Community.
  • Premium Community (Paid Subscription): This membership offers additional resources, exclusive content, and access to premium forums. Content in this tier is protected and is for your use only within the terms of this Agreement.
  • Auto-Renewal: Both monthly and annual Premium Memberships are set to auto-renew at the end of each billing cycle. By subscribing, you authorize us to automatically charge your payment method at the start of each renewal period until you cancel.

6. CONTENT SHARING AND USAGE

While we encourage sharing ideas and collaborating, we have strict rules regarding the distribution of our content:

  • Open Community Members: You may share general ideas and discussions within the Community but must respect the intellectual property of others.
  • Premium Community Members: You may use resources for your personal and professional development. However, these resources must not be shared outside the Community, except for therapeutic or instructional purposes directly involving individuals on your caseload, with appropriate confidentiality measures in place. No redistribution of Premium content to non-members is allowed.

7. CONFIDENTIALITY AND ETHICS

All members must adhere to professional ethical guidelines and the Health Insurance Portability and Accountability Act (HIPAA) regulations. Confidentiality is paramount. Do not share any client-identifying information or images without explicit, formal authorization from the client or their guardian.

8. COMMUNITY CONDUCT AND ZERO TOLERANCE POLICY

We are committed to fostering a supportive and respectful environment within the Communication Community. As such:

  • Zero Tolerance for Bullying, Discrimination, or Harassment: We have a strict zero-tolerance policy for any form of bullying, discrimination, or harassment. All members are expected to treat each other with kindness and respect. Any violations will result in immediate action, including possible termination of your membership.
  • No Solicitation: Members are prohibited from unsolicited promotion or selling of products and services. However, if a member explicitly asks for recommendations or support (e.g., advice on finding an occupational therapist in their area), you are welcome to provide helpful information.
  • Be Kind and Courteous: We encourage all members to engage in a positive, supportive manner. Please be kind and courteous in all interactions. This Community thrives on mutual respect and the shared goal of professional growth.

9. INTELLECTUAL PROPERTY AND CONTENT USE

To protect the integrity of the Community’s resources and content:

  • No Redistribution or Resale: You may not sell, redistribute, or share any content from the Communication Community, particularly from the Premium tier, with non-members. This includes sharing materials on any public or private platforms where others can access them.
  • No Unauthorized Storage: You may not save any of the Community’s content onto any sort of folder, drive, or cloud storage where it can be accessed by others outside the Community. You may store them in a personal (i.e., private) folder, drive, or cloud.
  • No Plagiarism: Members are expected to respect the intellectual property of others. You may not take any ideas, resources, or products from the Community and claim them as your own. We value originality and expect you to uphold these standards.

10. AMAZON ASSOCIATES DISCLOSURE

Some links within our Community, particularly in resource recommendations and content shared by the Community administrators, may lead to Amazon.com. As an Amazon Associate, Communication Community LLC earns from qualifying purchases. This helps support our efforts to provide valuable resources and content to our members. We appreciate your support and want to ensure full transparency in our affiliate relationships.

11. AFFILIATE OPPORTUNITIES

We are excited to offer an affiliate program to members who are passionate about our resources and community. If you are interested in joining our affiliate program, please reach out to us at hello@communicationcommunity.com. As an affiliate member, you will be able to earn commissions by promoting our membership and products to your network.

  • Affiliate Conduct: Affiliate members are expected to uphold the same standards of respect, integrity, and confidentiality as all other members of the Community. You may not engage in any misleading or deceptive practices while promoting our products.
  • Content Use: Affiliate members may use the promotional materials provided by the Community but may not alter them or create their own without prior approval.
  • Monitoring and Compliance: We reserve the right to monitor affiliate program activities to ensure compliance with our guidelines. Affiliate members found in violation of our policies may have their affiliate member status revoked.

12. CANCELLATION POLICY

We offer flexible subscription options to cater to the diverse needs of our members. As much as we will be sad to see you go, we want to ensure that you never feel stuck in a membership. Our cancellation policy is designed to be fair and transparent:

  • Flexible Subscription Types: Beginning 8/22/24, we offer monthly and annual subscription options for our Premium Membership. 
  • Cancellation Process: You can cancel your subscription at any time by visiting your account settings and following the prompts for cancellation. If you need assistance, our support team is available at hello@communicationcommunity.com.
  • No Refunds Policy: We do not offer refunds upon cancellation. Our membership provides immediate access to a comprehensive library of resources and materials valued at approximately $1000, which can be downloaded instantly. Once a membership is canceled, you will not be charged past your originally selected billing cycle.
  • Access Until the End of the Billing Cycle: Upon cancellation, you will retain access to your subscription benefits until the end of your current billing cycle, including full access to our resource library, community forums, and other benefits.
  • No Further Charges: After cancellation, your subscription will not renew, and you will not be charged for any subsequent billing cycles.
  • Rejoining the Community: You are always welcome to rejoin the Community in the future. You can resubscribe at any time to regain access to all Premium Membership features.

Note: For Premium (legacied) members who joined on or before 8/22/24, your subscription option is still honored for the duration of your selected billing cycle under the same cancellation terms.

13. RECORDING AND REDISTRIBUTION OF CONTENT

As part of the membership experience, the Community offers various interactive sessions, such as bi-weekly Office Hours. These sessions are recorded and may be redistributed or resold as part of future offerings. By participating, you consent to these recordings and understand that they may be used by the Community.

14. DIGITAL MATERIALS ACCESS AND SHARING

All digital materials provided through the Communication Community are securely hosted on Google Drive. As a safeguard to maintain the integrity and exclusivity of our resources, we have the capability to monitor access to these materials. Specifically, if any resources are viewed or accessed by an email address not registered as a member of our Community, this will be flagged as a potential breach of our terms.

We want to emphasize that this measure is in place solely to protect the valuable content we've developed and to ensure that it remains within the Community. Members are reminded that sharing these materials with individuals outside the Community is strictly prohibited. We trust our members to uphold these guidelines, and we appreciate your cooperation in maintaining a secure and supportive environment for everyone.

15. TERMINATION OF MEMBERSHIP

We hope it won't come to this, but we reserve the right to suspend or terminate your access to the Community at our discretion, especially in cases of Agreement violations.

16. DISCLAIMER OF WARRANTIES

Our products and services are provided "as is." While we strive to keep our Community running smoothly, we disclaim all warranties, whether expressed or implied. Please refer to our Cancellation Policy for additional details.

17. LIMITATION OF LIABILITY

We are not liable for any indirect, incidental, or consequential damages arising from your use of our Community, products, or services.

18. GOVERNING LAW

This Agreement is governed by the laws of the jurisdiction in which our Community is headquartered.

19. MODIFICATIONS TO THE AGREEMENT

We may update this Agreement from time to time. When changes occur, we'll update the revision date at the top of this page. By continuing to use our Community after such changes, you agree to the revised terms.

20. ACCEPTANCE OF TERMS

By becoming a member of the Communication Community, you acknowledge that you have read, understood, and agree to this Agreement.
